Summary

SUMMARY

This position assists the misdemeanor prosecutors in all aspects of misdemeanor prosecution. The individual will have daily contact with the public, governmental officials and other law enforcement agencies. The Clerk IV should have excellent clerical skills and must be familiar with a variety of standard concepts, practices, and procedures within the legal field with knowledge of the Texas Code of Criminal Procedure and the Texas Penal Code. The Clerk IV is responsible for preparing correspondence and legal documents such as complaint and information's, motions to revoke, motions to adjudicate, judgments, and must solicit and compile pertinent data to facilitate the accurate and timely preparation of such legal documents for the misdemeanor prosecutors. The Clerk IV also answers the phone, routes calls to the appropriate person, and makes sure that the appropriate misdemeanor prosecutor receives all incoming documents. The Clerk IV pulls and prepares the files for both jury and non-jury dockets, making sure that all documents are in the appropriate files, and must collaborate effectively with other clerks to ensure high quality, dependable coverage at all times. The Clerk IV must maintain confidentiality of privileged and sensitive data or information at all times. This position is a backup for the Administrative Assistant I.

Essential Duties and Responsibilities

To perform this job successfully, an individual must be able to perform each essential duty satisfactorily. Duties include the following:

MISDEMEANOR - INTAKE
Receive misdemeanor cases.
Enter cases in software program.
Order necessary paperwork (Rap Sheets).
Coordinate with the prosecutors for witness list.
Prepare complaint, information, and file pleadings with the court.
Electronically file case and CJIS in Prosecutor.
Prepare dismissals for assigned attorney.
Prepare and file non-prosecution forms on JP cases.
Prepare paperwork for motions and settings for court.
PROBATION CASES: Prepare and file paperwork for Misdemeanor Motion to Revoke Probation and Motion to Adjudicate.
EVIDENCE: Request evidence from investigating agency and give to attorney with case.
JURY DOCKET Check jury lists for any prior criminal history of jurors.
Prepare posters, exhibits, etc. when necessary.
Send thank you letters to jurors.
Prepare judgments.
Assist the investigator with incoming calls regarding jury trial.
ASSIST ATTORNEY Compose and type letters.
Keep attorney up to date on any new documents or information received.
Perform other duties as directed by the misdemeanor prosecutors.
MISCELLANEOUS DUTIES Help answer phones and direct calls as necessary.
Help coordinate calendar for assigned attorney.
Complete other duties as may be assigned.

Mandatory Qualifications

EDUCATION and/or EXPERIENCE

A high school diploma or GED equivalent is required. One (1) to two (2) years of experience is required. Should possess a thorough working knowledge of clerical procedures and practices. Other specialized job requirements include good public relations skills, communication abilities, professional demeanor, use of a multi-line telephone, hands-on computer experience, and excellent writing skills. Experience in criminal and civil law would be helpful, but not required.

Desired Minimum Qualifications

LANGUAGE SKILLS

Ability to read and interpret documents such as statutes, rules, and judicial decisions. Ability to draft legal documents, such as briefs, pleadings, motions, and any discovery. Ability to communicate effectively with the public and persons in the legal system.

MATHEMATICAL SKILLS

Ability to add, subtract, multiply, and divide in all units of measure, using whole numbers, common fractions, and decimals. Ability to compute rate, ratio, and percent and to draw and interpret bar graphs.

REASONING ABILITY

Ability to apply commonsense understanding to carry out instructions furnished in written, oral, or diagram form. Ability to deal with problems involving several concrete variables in standardized situations.

CERTIFICATES, LICENSES, REGISTRATIONS

Legal Assistant certification preferred, but not required.

WORK ENVIRONMENT

The work environment characteristics described here are representative of those an employee encounters while performing the essential functions of this job. The individual will be required to work from 8:00 a.m. to 5:00 p.m. five days per week - hours could fluctuate depending on court or project. The office closes for lunch at 12:00 p.m. and reopens at 1:00 p.m. When covering for the receptionist the individual will be required to open the office at 8:00 a.m. and return from lunch no later than 1:00 p.m. The noise level in the work environment is usually moderate.
